Introduction

On the website of the Federal Ministry of Health, the new draft law for the decriminalisation of cannabis as a recreational drug has just been made public. Compared to the previously known information, the draft law has changed in some positive aspects.

Personal use and cultivation of cannabis

According to the last information known on this topic, every adult citizen was supposed to be allowed to grow up to three cannabis plants a year to cover personal needs. The cultivation must be inaccessible to other people, especially children, and must not cause any nuisance to others. A significant detail has changed here, as now also three plants are to be legal, but not per year, but at the same time.

Unsocial cannabis clubs

In the basic features, the current version of the draft law cannot surprise. The possession limit for cannabis in public space remains at 25 grams. Minors are prohibited from possession and consumption, and consumption must not take place near (= less than 200 metres away) facilities for child and youth welfare, schools, kindergartens or playgrounds.

Future challenges

Understandably, there is also much to criticise about the current version of the draft with the not very elegant title "Law on the controlled handling of cannabis and the amendment of other regulations". Perhaps the parliamentary process can bring about changes in one place or another. However, it is rather unlikely that the cannabis clubs will become social after all and will probably remain a task that the community will have to take on in the future.
